What is Family Medical Leave?

The Family Medical Leave Act (FMLA) was enacted with the purpose of helping employees balance their work and family responsibilities. The entitles eligible employees of covered employers to take up to 12 weeks for job-protected, unpaid leave each year for any of the following reasons:
  • For the birth and care of the newborn child of an employee (both the mother and father of a newborn child are entitled to FMLA leave);
  • For placement with the employee of a child for adoption or foster care;
  • To care for an immediate family member (spouse, child or parent) with a serious health condition; or,
  • For the employee's own serious health condition.


Who is eligible for FMLA leave?

An employee who has worked for an employer for at least 12 months and at least 1,250 hours over the past 12 months and work at a location where the employer employs 50 or more employees within 75 miles is entitled to take FMLA Leave.

What are my FMLA Rights?

  • Continuation of group health insurance coverage just as if you had continued to work;
  • Job Restoration - You are entitled to be restored to your job or an equivalent job upon your return from FMLA leave;
  • Employers are prohibited from interfering with, restraining or denying the exercise or attempt to exercise FMLA rights.
